MEMORANDUM OF AGREEMENT

To fully comply with the J-1 regulations administered by the U.S. Department of States (DOS) Exchange Visitor Program, Pace University (hereinafter, “PACE”) and Guangdong University of Finance and Economics (hereinafter, “GDUFE”) have agreed to update the Supplement 3 to the following version.

 

As a result of friendly negotiation, Pace University and Guangdong University of Finance and Economics have decided to enter this Supplement 3 to this MOA for collaborating in establishing the “Guangdong University of Finance and Economics Overseas Faculty Development Base – Pace University.”

 

Section 1: PERIOD OF AGREEMENT. This agreement is Supplement Three to the Memorandum of Agreement (“MOA”) between the above institutions, dated February 3, 2014, and is subject to the terms and conditions of the MOA. This Agreement is effective for a period of five (5) years and can be renewed every five (5) years upon the mutual, written consent of both parties.

 

Section 2: PROGRAM OBJECTIVE. The objective of this program is to support GDUFE faculty development through one semester of (a) supervised research relevant to GDUFE faculty’s current teaching responsibility, (b) study of the current teaching methodologies, and (c) development of skills in delivering courses in GDUFE faculty’s domain in English.

 

Section 3:  ADMISSION AND ENROLLMENT OF GDUFE FACULTY AS VISITING SCHOLARS.  GDUFE Administration will select a cohort of faculty as visiting scholars (hereinafter, “GDUFE FACULTY) with a list of participants provided to Pace University two months in advance. Participants will attend one semester of study at Pace University. The selection process will include verification of English Language proficiency.

 

GDUFE FACULTY participating in the program could audit two undergraduate or graduate courses from PACE course catalogue, and attend weekly custom-designed seminars on international higher education concepts and methodologies delivered by Pace University School of Education.

 

Section 4: STATUS. GDUFE FACULTY will attend PACE as visiting scholars. They will not receive any transcript or degree from PACE. Upon completion of this visiting scholar program, PACE should issue for each GDUFE FACULTY member an official assessment of his or her overall performance.

 

Section 5:  SERVICE FEE. GDUFE FACULTY should pay a service fee at the level of full tuition of the audited courses and attended seminars on the basis of credits at the rates as posted by each school/college on the Pace University website (www.pace.edu) and in the PACE catalog. Tuition rates may vary depending on the courses selected.

 

Section 6:  MANAGEMENT FEE. Each GDUFE FACULTY member needs to pay $800 program management fee for program management, secretary services, course registration, curriculum resources, seminar organization, teaching assistants, bilingual services and English training, and faculty assistance and assessment.

 

Section 7:  MISCELLANEOUS FEE. Each GDUFE FACULTY member needs to pay $400 miscellaneous fee including PACE standard program application fee and technology fee.

 

Section 8:  OTHER COSTS. Other costs not mentioned above, including international and domestic travel, lodging, food, are the responsibility of the GDUFE FACULTY.

 

Section 9: INFORMATION AND ORIENTATION. At least two months prior to each academic term, PACE will provide GDUFE FACULTY with detailed curricular and extra-curricular information relevant to their attending PACE including, if necessary, procedures and supporting documents required to obtain immigration documents. Upon arrival at PACE, GDUFE FACULTY will receive an on-site orientation covering the full range of academic and non-academic services and facilities. GDUFE FACULTY will have the same access to all PACE services and facilities as other visiting scholars, including, but not limited to, the library, technology, recreation, and cultural activities.

 

Section 10: HOUSING. PACE will not provide housing for any GDUFE FACULTY. Housing is the sole responsibility of the GDUFE FACULTY. PACE will provide GDUFE FACULTY local lodging information two months before the start of each semester.

 

Section 11: HEALTH AND INSURANCE. GDUFE FACULTY are required to demonstrate full medical coverage in the USA. PACE offers GDUFE FACULTY a mandatory insurance policy. GDUFE FACULTY who wish to waive this insurance must provide proof of alternative and comparable insurance coverage according to PACE deadlines and guidelines. Once in the USA, PACE will assist GDUFE FACULTY who require medical assistance in finding appropriate facilities. The cost of insurance coverage and medical assistance shall be the sole responsibility of GDUFE FACULTY.

 

Section 12: CONDUCT. GDUFE FACULTY will be subject both to PACE’s student conduct policies and academic integrity codes and to GDUFE’s academic integrity codes.

 

Section 13. LIABILITY. Neither PACE nor GDUFE will be liable for damages caused by GDUFE FACULTY to their own or other persons and property, including damage due to abuse of alcoholic beverages, medicines, or illegal drugs. GDUFE FACULTY will be individually liable for the economic and legal consequences of their personal actions and will be subject to the laws of the USA. Neither PACE nor GDUFE shall be held liable or responsible for failure of a GDUFE FACULTY member to obtain or retain a visiting scholar visa for reasons beyond the control of PACE or GDUFE. Neither institution will be liable for any failure or delay in performing the obligations of this agreement caused by acts of God, terrorism, natural disasters, war, public enemy, or other similar catastrophes. Each institution will protect and hold harmless the other from any loss, claim, or damage resulting from wrongful acts or omissions.

 

Section 14.  UNCOVERED ITEMS. New issues uncovered in this agreement should be resolved by prompt negotiation between the two parties.

 

Section 15.  PROGRAM DIRECTOR. PACE and GDUFE name Dr. Lixin Tao, Chairperson of Computer Science Department, as the Director of this program. The director’s responsibilities include GDUFE FACULTY screening, supervision, management, information exchange, course registration for auditing, and assessment. The director has permission to register GDUFE FACULTY into any PACE scheduled courses for auditing upon instructor approval, and access GDUFE FACULTY academic records. The director is the default academic advisor during GDUFE FACULTY’s visit with PACE.

 

Section 16. OFFICIAL NOTE. PACE names program director Dr. Lixin Tao, Chairperson of Computer Science Department, as PACE primary contact for this program, and GDUFE names Mr. Xinbo Li, Director of GDUFE Office of International Exchange and Cooperation, as GDUFE primary contact for this program. PACE and GDUFE will exchange complete information regarding GDUFE FACULTY prior to program commencement and as needed throughout the duration of GDUFE FACULTY’s participation in this Visiting Scholar Program.
